1. Publication Reference
Consulting services for the supervision of works on Split Bypass on the national road D8, section 01: Plano–Kaštel Sucurac, LOT 1: Plano–Kaštel Stari, length 4,2 km, section 02: Stobrec–Dugi Rat, LOT 1: TTTS (Stobrec)-Grljevac, length 3,2 km and section 03: Dugi Rat-Omiš  LOT 4: Tunnel Omiš–Omiš, length 2,82 km.

2. Procedure
International tendering, open to nationals of all countries.

3. Financing
Hrvatske ceste d.o.o. Zagreb, Croatia (state owned company) from its own budget and proceeds from the loan issued by European Investment Bank (Luxembourg).

4. Legal Basis
Finance Contract 23.135 HR made between Hrvatske ceste d.o.o. and European Investment Bank dated 20 July 2005.

CONTRACT SPECIFICATION

6. Contract Description
Consultant services will consist of supervision of works on Split Bypass Project:

• on the Section 01: Plano–Kaštel Sucurac, LOT 1: Plano–Kaštel Stari, length 4.2 km - construction works of highway, i.e. construction of 2 lane carriageway, two overpasses and one underpass, alternative roads, drainage and landscaping. The overpasses are – overpass Os 21, L=40 m, and overpass Os 25, L= 40 m; underpass is the underpass Os 22, L= 45 m;

• on the Section 02: Stobrec–Dugi Rat, LOT 1: TTTS (Stobrec)-Grljevac, length 3,2 km - construction works of highway, i.e. construction of 4 lane carriageway, two tunnels, bridge, overpass and underpass, drainage, slope protection, noise protection and landscaping. The tunnels are Tunnel PERUN - two tubes (south tube L=222.32 m, north tube L=201.92 m) and the Tunnel RUDINE – two tubes (south tube, L=360.52 m, north tube, L=363.23 m). The structures are: bridge ŽRNOVNICA, L=556.00 m, underpass GRLJEVAC, L= 20 m, and overpass TTTS, L=241.50 m; 

• on the Section 03: Dugi Rat–Omiš, LOT 4: Tunnel Omiš–Omiš, length 2.82 km - construction works of highway, i.e. construction of 2 lanes of carriageway, two tunnels, three viaducts and interchange Omiš, drainage, retaining walls and slope protection. The overall length of tunnels is 1.697 km (Tunnel Omiš, L=1.471 km; and Tunnel Brzet, L=226 m). The Interchange Omiš includes 3 viaducts: viaduct Interchange Omiš 1, L=167.60 m; viaduct Interchange Omiš 2, L=194.09 m; and viaduct Interchange Omiš 3, L=128.00 m. The overall length of the viaducts is 489.69 m.

7. Completion Period
The supervision of works on Split Bypass (Section 01: Plano – Kaštel Sucurac, LOT 1: Plano–Kaštel Stari, length 4,2 km, Section 02: Stobrec–Dugi Rat, LOT 1: TTTS (Stobrec)-Grljevac, length 3,2 km and Section 03: Dugi Rat-Omiš  LOT 4: Tunnel Omiš–Omiš, length 2,82 km) have to be carried out in the period of 26 months.


CONDITIONS OF PARTICIPATION

8. Eligibility
This invitation to tender is open on equal terms to any firms/legal persons participating either individually or in a grouping (Consortium) of tenderers.

9. Grounds for Exclusion
Firms of a country may be excluded if, in accordance with a decision of the United Nation Security Council taken under Chapter VII of the Charter of the United Nations, the Employer’s country prohibits any participation of firms from that country in works in other countries, or any payments to persons or entities in that country.

10. Number of Tenders
Each tenderer shall submit only one tender either by himself, or as a partner in a Consortium.Tenders for partial performance of services will not be considered. Alternatives are not allowed.

11. Tender Security
The tendered shall furnish a tender security issued by a commercial bank acceptable to the Employer, in the amount of HRK 480,000.00. The security will be returned to unsuccessful tenderers upon completion of tender procedure and to the successful tenderer upon signature of the contract by both parties (the Employer and the Consultant). The security will be forfeited if the tenderer fails to comply with the requirements of tender documents. 

12. Pre-tender Meeting
The Employer will convene a pre-tender meeting which will take place on 2 August 2007 at 12.00 m. (local time) at the Employer’s premises at Voncinina 3, Zagreb.


TENDERING

13. How to obtain Tender Documents
Tender documents are available form the Employer, at the above mentoned address, the second floor, room 201 (Snježana Kurek tel: ++385/01–4722–497; fax: ++385/01–4722–491, e-mail: snjezana.kurek@hrvatske-ceste.hr).

The tender documents may be obtained upon a bank transfer of a non-refundable fee of 100 EURO, including VAT, to the bank account of Hrvatske ceste d.o.o. open at Privredna banka Zagreb:

Each tenderer or partner in a Consortium has to buy a tender document.

Upon a written request accompanied by evidence of payment, the Employer will send the tender documents by mail, but will in no way be responsible for possible delays in shipment or loss of these documents. Tenderers who require delivery of tender documents by courier will bear the cost of such a delivery.

14. Tender Submission Requirements
Tenderers shall submit their tenders in English and Croatian language, using the standard forms included in tender documents, strictly observing the formats given.

15. Deadline for Submission of Tenders
42 calendar days after the date of publication of this procurement notice in the Official Journal of the European Union, that is not later than 23 August  2007 at 12.00 m. (local time). Any tender received after this deadline will not be considered for evaluation.


16. Public Tender Opening Session
The time and venue of the tender opening session: 23 August  2007 at 12.00 m. (local time), in Voncinina 3, Zagreb, room 400. Authorised representatives of tenderers may attend the session.

17. Tender Validity
Tenders shall remain valid for a period of 90 days after the deadline for submission of tenders.


SELECTION CRITERIA AND AWARD OF CONTRACT

18. Evaluation Criteria
Evaluation of legal, economic, financial and technical responsiveness of tenders will be carried out in accordance with the following main considerations:

• Past performance in the last three years (contracts committed or completed within the years 2004, 2005 and 2006) as the leading partner (main Consultant) on projects similar by type, scope and complexity to the contract for services procured under this tendering;
• Average annual turnover (defined as contracts completed or underway) in the last three years in the value of the proposed services;
• Qualifications and experience of key staff;
 Special attention of foreign companies is drawn to the conditions requested for key staff in accordance with the Croatian laws in force; see:
• Section 2 . ITT Clause 2. Definitions;
• Section 2. ITT Clause 10. Document comprising Tender, Part 2 Methodological approach and staffing, ii) Key personnel; and
• Section 3. Terms of Reference, Clause 6. Required inputs;
• Equipment.

19. Contract Award Criteria
Combined criteria of quality competence and responsiveness of the Consultant’s proposal and that of his proposed staff, and the offered price for the services.

20. Performance Security and Contract Award
For contract signing the successful tenderer will be required to furnish the performance security in the amount of 10% of contract price expressed in HRK or in EUR. The singing of contract and furnishing of performance security shall be carried out within 28 days after receipt of the contract signed by the Employer.  Failure of the successful tenderer to sign the contract and furnish the performance security within the deadline shall constitute a breach of contract, and the Employer may resort to awarding the contract to the next ranked tenderer.
