CONTRACT SPECIFICATION
6. Contract description
The works will be carried out on the State road No. 8, frontier crossing PASJAK – RUPA in the length of 5 578,61m. The rehabilitation works comprise pavement strengthening of the existing road, slope protection with wire mash and reduction of slope, construction of retaining wall, improvement of water drainage system, reconstruction of culverts (drainage) and bus stop areas, as well as improvement of safety at intersections and new traffic signalisation.
7. Maximum works period
8 months from the Notice to Commence.
CONDITIONS OF PARTICIPATION
8. Eligibility
Participation is open on equal terms to all firms / legal persons participating either individually or in a grouping (joint venture) of tenderers.
9. Grounds for exclusion
Firms of a country may be excluded if, in accordance with a decision of the United Nations Security Council taken under Chapter VII of the Charter of the United Nations, the Employer’s country prohibits any participation of firms from that country in works in other countries, or any payments to persons or entities in that country.
10. Number of tenders
Tenderers including firms within the same legal group, other members of the samejoint venture, may submit only one tender.
Tenders for parts of the Works will not be considered. Tenderers may not provide a tender for a variant / alternative solution in addition to their tender for the Works required in the tender documents.
11. Tender guarantee
Tenderers must provide a tender guarantee issued by a first class bank amounting to 2% of the tender price when submitting a tender. This guarantee will be released to unsuccessful tenderers once the tender procedure has been completed and to the successful tenderer upon signature of the contract by both Parties (i.e. Employer and Contractor). The guarantee will be forfeited if the Tenderer does not fulfil all obligations stated in its tender.
12. Clarification Meeting
A clarification meeting will be organised by the Employer and it will be held on November 23, 2005, at 11:00 AM, in Employer’s premises in Voncinina 3, Zagreb.

13. How to obtain the Tender Documents

At written Candidates-firms request, accompanied by the payment evidence, the Employer shall send Tender Documents by mail to these firms, but in no way will be responsible for possible delay in shipment or loss of these documents. Tenderers, which require the tender document to be sent to them by courier, will be required to pay for the cost of such delivery.
14. Tender submission conditions
Tenders must submit their tenders in English language, using the standard Tender submission form included in the tender documents, format and instructions of which must be strictly observed.
15. Deadline for submission of Tenders
56 calendar days after the date of publication of this procurement notice in the Official Journal of European Communities, i.e. December 13, 2005 until 12:00 M local time. Any Tender received after this deadline will not be considered.
16. Public tender opening session
The time and venue of the tender opening session are as follows: December 13, 2005 , 12:00 M local time, at Voncinina 3, 10.000 Zagreb, Croatia, room No. 400. The session may be attended by designated and authorised representatives of Tenderers having submitted Tenders.
17. Tender validity
Tenders must remain valid for a period of 90 days after the deadline for submission of Tenders.
SELECTION CRITERIA and AWARD of CONTRACT
18. Selection criteria
The selection of the legally, economically, financially and technically responsive tender will be carried out in accordance with the following main considerations:
• references of executed similar contracts / works of at least one rehabilitation road project in 8 km length, and railway overpass and underpass during the past five (5) years; and references of minimal average of 25 000 t of asphalt laid down per year in the last three (3) years (2004, 2003, 2002); give the list of the projects where the total quoted quantities of asphalt have been successfully laid and the Investors certificate of the successfully laid asphalt on the projects set forth;
• average annual turn-over during the last three years (2004, 2003, 2002) of at least € 5,5 million, or HRK 40 million.
19. Contract award criteria
The price, as specified in Instructions to Tenderers.
20. Performance guarantee and contract award
The successful Tenderer will be requested to provide a performance guarantee of 10% of the contract value in HRK or in euro, when counter-signing the Contract.
The counter-signing of contract and the procuring of performance guarantee must be carried out within 28 days after receipt by the succesful Tenderer of the Contract signed by the Contracting Authority.
If the selected Tenderer fails to counter-sign the Contract and provide such a guarantee within this compulsory period, the Contract will be void and a new contract may be drawn up and sent to the Tenderer, which has submitted the next lowest, responsive tender.
